These Terms of Service (the Terms) apply when you access or use our website, place an order, visit our store, or otherwise use our services (the Services). By using the Services you agree to these Terms and to any policies referenced here (including our Privacy Policy, Returns Policy, and Cookie Policy). If you do not agree, you must not use the Services.

Our online store is hosted by Shopify.


1) Eligibility & your account

  • Age. You must be at least 18 (or the age of majority in your location) to purchase. If you are under that age, you may only use the Services with a parent/guardian’s involvement and consent.

  • Account security. Keep your login details confidential. You are responsible for activity on your account unless caused by our breach. Tell us immediately if you suspect unauthorised use.

2) Ordering with us

  • Placing an order. Your order is an offer to buy the product(s) listed in your basket. We will acknowledge receipt by email. Acceptance occurs when we send a Dispatch Confirmation email; at that point a contract is formed.

  • We may decline or cancel. We may refuse or cancel all or part of an order (for example if a product is unavailable, a pricing or stock error occurs, we cannot obtain authorisation for payment, or we suspect fraud). If payment has been taken for a cancelled order we will refund you in full for the cancelled items.

  • Product colours & sizing. We aim to display colours and measurements accurately, but variations may occur due to screen settings and natural manufacturing tolerances. Minor variations do not affect your statutory rights.

  • Pre‑orders/backorders. Estimated delivery dates are indicative. We will notify you of material changes; you may cancel a pre‑order for a full refund before dispatch.

3) Prices, taxes & currency

  • Prices. Prices shown at checkout are the price for the products. For UK/IE/EU customers, prices are typically shown inclusive of VAT where applicable. For customers outside the UK/EU, local taxes may apply at import.

  • Errors. If we discover an error in price or availability, we will contact you and give you the option to reconfirm or cancel before shipment.

  • Duties & import. International orders may be subject to customs duties, fees and taxes levied once a shipment reaches your country. These are your responsibility unless we say otherwise at checkout.

4) Payment

We accept the payment methods shown at checkout (for example, Visa, MasterCard, AMEX, PayPal, Shopify Payments). By submitting payment details, you represent that you are authorised to use the chosen method and authorise us (and our payment provider) to charge the full order amount, including any shipping, taxes and duties.

5) Shipping, delivery & risk

  • Delivery estimates. Any delivery dates are estimates only. We’ll try to deliver within the stated timeframes but delays can happen.

  • Risk & title. Title passes when we have received full payment. Risk passes to you on delivery to the address you provide (or to the carrier if you arrange your own collection).

  • Failed deliveries. If a delivery is returned to us due to an incorrect address or failure to collect, we may charge for re‑delivery.

6) Returns, exchanges & refunds (summary)

We offer a 30‑day return window for most items. You may return eligible products for a refund within 30 days of delivery (we count from the day after you receive the goods). This sits alongside—and does not reduce—any statutory rights in your country (see the Supplements).

Conditions

  • Items must be unworn, unwashed and in resaleable condition with all tags attached and hygiene seals intact (where applicable).

  • Exclusions: earrings, underwear, and swimwear where the hygiene seal is removed; personalised or customised items; final‑sale items unless faulty.

  • Original shipping fees are non‑refundable unless we made an error or the goods are faulty.

Return postage

  • For change‑of‑mind returns, you pay the return postage. We recommend a tracked service and retaining proof of posting.

  • If an item is faulty or not as described, contact us first; we will repair/replace or refund in line with your local rights and, where we request a return, we’ll cover or reimburse reasonable return costs.

How to return

  • Email info@jacux.com with your order number and the item(s) you wish to return; we’ll share the return address and steps. Exchanges are subject to stock availability.

UK/IE/EU customers: you also have a 14‑day right to cancel most online purchases (see Supplement A for details on deadlines and refunds).

7) Promotions, discount codes & gift cards Promotions, discount codes & gift cards

  • Promotions & codes. One code per order unless stated. Codes cannot be exchanged for cash, have no cash value, and may have eligibility rules and expiry dates.

  • Gift cards. Gift cards are redeemable only at our store, are not reloadable and (unless required by law) are non‑refundable and not exchangeable for cash. Treat them like cash; lost or stolen cards will not be replaced. If an expiry period is stated on the card or at purchase, that period applies; otherwise no expiry.

8) Intellectual property

All content on the Services (including text, images, graphics, videos, logos and trademarks) is owned by or licensed to us and is protected by intellectual property laws. You may use the Services for personal, non‑commercial use only. You must not copy, reproduce, modify, distribute, sell or exploit any content without our prior written permission.

9) Your content (reviews, photos, social tags)

If you submit or tag content relating to our products or brand, you grant us a worldwide, royalty‑free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify and display that content in connection with the Services, our social channels and marketing, in any media, subject to our Privacy Policy. You promise that you own or control the rights to the content and that our use will not infringe anyone else’s rights.

10) Acceptable use

You must not: (a) use the Services unlawfully; (b) post or transmit harmful, infringing, defamatory, obscene or otherwise objectionable content; (c) access without authority, interfere with or damage any part of the Services, our equipment, data or networks; (d) scrape, crawl or use automated means without our consent; (e) introduce viruses, malware, or other harmful code; or (f) infringe our or others’ intellectual property rights.

11) Third‑party services

The Services may link to or integrate with third‑party sites and services (for example, payment processors, couriers, social media). We are not responsible for third‑party sites or their terms and policies. Your use of those services is at your own risk.

12) Errors & availability

We work hard to ensure the information on our site is accurate, but mistakes can happen. We may correct any errors or omissions and change or update information at any time without prior notice, including after you have placed an order. If a change affects an order you have placed, we will contact you.

13) Warranties & disclaimers

Except as set out in these Terms and as required by applicable law, the Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied (including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non‑infringement). Nothing in these Terms limits or excludes any non‑excludable statutory rights (see the Country/Region Supplements).

14) Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited by law.
Subject to the foregoing and to the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special or consequential loss; (b) we are not liable for losses not foreseeable when the contract was formed; and (c) our total liability for any loss arising out of or in connection with any order will be limited to the amount you paid for the product(s) giving rise to the claim.

15) Indemnity for misuse

You agree to indemnify and hold us harmless from any claims, damages, losses, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

16) Force majeure

We are not responsible for any delay or failure to perform due to causes beyond our reasonable control (including acts of God, labour disputes, supply chain issues, epidemics/pandemics, war, terrorism, government action, utility failures, or internet outages).

17) Changes to the Services or these Terms

We may update the Services and these Terms from time to time. If we make material changes to the Terms, we will post the updated version and change the “Last updated” date above. The version in force when you place an order will apply to that order.

18) Assignment

We may transfer our rights and obligations under these Terms to another organisation. You may only transfer your rights or obligations with our written consent.

19) Governing law & jurisdiction (global)

These Terms are governed by the laws of England and Wales, without regard to conflict‑of‑laws principles. The courts of England and Wales will have non‑exclusive jurisdiction. If you are a consumer, you may also be able to bring proceedings in your country of residence where mandated by consumer protection laws.


Country/Region Supplements

The following supplements add to or modify the Terms for residents of the listed countries/regions. If there is a conflict, the supplement for your region applies.

A) United Kingdom & Ireland (and EU customers ordering from us)

  • Right to cancel (distance selling). You have a legal right to cancel most online purchases within 14 days from the day after you (or someone you nominate) receives the goods. To cancel, email info@jacux.com with your order details. You must send back the goods without undue delay and within 14 days of telling us you wish to cancel. We will refund the price paid (and the standard delivery cost, if charged) within 14 days of receiving the goods back or proof you have sent them back. You are responsible for the cost of return unless the item is faulty or not as described. Exclusions apply (e.g., sealed goods not suitable for return due to health protection or hygiene reasons once unsealed; personalised or customised items). Your statutory rights are unaffected.

  • Non‑conforming/faulty goods. If a product is faulty or not as described, you may be entitled to repair, replacement or refund according to your statutory rights. Contact us and we’ll help.

  • VAT invoices. Available on request.

  • EU ODR platform. If you live in the EU, you may use the EU Online Dispute Resolution platform to raise a complaint: https://ec.europa.eu/consumers/odr/

B) United States

  • Sales tax. Applicable sales taxes will be calculated and shown at checkout where required by law.

  • Warranty disclaimers. To the fullest extent permitted, we disclaim implied warranties of merchantability and fitness for a particular purpose. Some states do not allow limitations on implied warranties, so the above may not apply to you.

  • Limitation of liability. Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of Section 14 may not apply to you.

  • California residents. If you have a complaint, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

C) Canada

  • Taxes. We collect GST/HST and, where applicable, PST/QST.

  • Consumer rights. Nothing in these Terms limits your rights under applicable provincial consumer protection laws. Quebec consumers may have additional rights.

D) Australia

  • Australian Consumer Law (ACL). Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies the consumer guarantees under the ACL.

E) New Zealand

  • Consumer Guarantees Act (CGA). Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. If you are acquiring goods for the purposes of a business, you agree the CGA does not apply.

  • Gift card expiry: set a specific term or no expiry.

  • US arbitration/class‑action waiver: include if you’d like to use arbitration for US customers.

  • 10‑year product guarantee: integrate once finalised (we can add a section referencing the guarantee terms).
